Focus on donations of personal property

When making a donation of personal property, it is important to consider two factors.

  • Firstly, your place of residence for tax purposes. Taxation is not the same in Wallonia, Brussels, and Flanders.
  • Secondly, your marital status. Are you married, legally cohabiting, in a common-law relationship, or single? Do you have a marriage contract or not?

With that in mind, you are completely free to give whatever amount you want to whomever you want.

In practical terms, you have two options

Solution 1: Register the donation

In this case, it will cost you 3.3% of the capital donated in the Walloon Region to your spouse, children, or grandchildren; in other cases, it will be 5.5% of the capital donated. This is a very low rate compared to inheritance tax, which can quickly rise to 30% for direct descendants and even up to 80% for third parties, including cohabiting partners. This registration guarantees you a definitive and immediate exemption from inheritance tax on the capital donated.

Solution 2: Private donation

There is another alternative. You can make a private donation, i.e., free of charge, at a rate of 0%, on the sole condition that you survive for three years after the date of the donation. To do so, you must comply with certain tax formalities certifying your intention to give, receive, and transfer the capital. The RGF Group will take care of everything for you.

But what happens if you die within three years? In this case, the gift you made will be added back to your estate. In other words, your heirs will be taxed as if the gift had never been made.
